10th March 2011 at active assistance of Union of the Legal Person of the form Association «Internet Association of Kazakhstan». (IAK) there was signed the agreement on peaceful settlement of the dispute concerning forum “Центр тяжести” (CT)
A Lean Compromise Is Better Than A Fat Lawsuit
On 15th April 2010 during the press-conference that took place in Kazakhstani press-club the representatives of Erzhan Isabaev openly expressed claims of the latter to his partner in “New Line Media, Ltd.” Dmitry Zimin concerning “Центр тяжести” forum located in Internet http://bb.ct.kz.
After that from April 2010 till February 2011 there were a number of court sessions in different agencies. Finally, on 24th April 2011 the decision of Specialized interdistrict economic court of Almaty dated 11th October 2010 #2-9819/10 took legal effect.
Unfortunately, the legislative and regulatory-legal base in the sphere of internet is not perfect. Thus, IAK’s primary aim was to attract maximum attention of community and state structures to this process. Being sure that internet is innovative and most prospective branch of economy of Kazakhstan, that’s why it is very important to direct development of Kaznet in civilized way, we addressed to mass media, NEP “Atameken”, Parliament of Kazakhstan, Agency of RK for Economic and Corruption-Related Crimes, General Prosecutor’s Office of Kazakhstan, Supreme Court of RK with a request to control and assist in its legal decision.
Besides, under the legal commission of IAK they created Coordination center concerning situation with internet resource “Центр тяжести” to coordinate all the processes and consolidate all official information regarding situation with CT. All information is timely placed on the site of the center http://ct.iak.kz and allows internet users to be sure in the accuracy of this or that fact or term.
Eventually, the final resolution of the conflict was in power of public organization uniting professionals IAK, in association with the member of presidium of Lawyers union of Kazakhstan German Nurbaev and representatives of “Legal Company “German”.
This is the first time in Kazakhstan that such conflict in the sphere of internet was resolved by peaceful settlement. This precedent makes us think about creation of special pre-trial agency or arbitration court under IAK.
Union of the Legal Person of the form Association “Internet association of Kazakhstan” expresses its acknowledgement to both parties of the conflict, to Mr. E. Isabaev, Mr. D. Zimin, Mr. V. Turekhanov, Mr. A. Uskov, and the lawyer G. Nurbaev for understanding and support in signing the agreement on peaceful settlement.
